Sea Tow obtains federal registration of the “Color Yellow”

SOUTHHOLD, N.Y. – The United States Patent and Trademark Office issued a certificate of registration to Sea Tow, giving them exclusive rights to use the color yellow, Sea Tow stated in a press release.

The certificate established that the color yellow meets all requirements for federal trademark and registration, confirming Sea Tow’s exclusive right to use the color yellow in connection with its marine assistance in the U.S. The registration protects the company and boaters from imposters using the color yellow on their boats, the release stated.

“This is a major victory for Sea Tow and one that has been hard fought over the years,” Capt. Joe Frohnhoefer, Sea Tow’s founder and CEO, stated in the release. “This historic trademark registration protects our brand and franchise owners nationwide against imitators and imposters. It assures boaters that the yellow-hulled boat responding to them is, in fact, a skilled, experienced, insured and U.S. Coast Guard licensed professional Sea Tow provider.”

Sea Tow has been promoting the color yellow as a brand identifier, and has won several court cases against “copycat” marine assistance companies who were using the color yellow on their vessels’ hulls. These cases set the stage for Sea Tow’s trademark victory.

The certificate of registration states that only boats operated by Sea Tow and/or its franchisees have the exclusive right to use boats with yellow colored hulls while performing these services. It covers the use of the color yellow for diving and underwater salvage; marine salvage; vessel salvage; emergency and non-emergency transportation by boats; delivery of fuel and other supplies by boat; and boat delivery, specifically towing by boat.

Sea Tow Services International provides marine assistance throughout the U.S., Europe, Australia, the U.S. Virgin islands and Puerto Rico.
