Court issues injunction in Duncan McIntosh Co. case
SANTA ANA, Calif. – A district court judge has issued a preliminary injunction stopping the use of the Duncan McIntosh Co. boat-show names by the Southern California Marine Association (SCMA) and The Dunes Resort and Marina, the Duncan McIntosh Co. reported in a statement yesterday.
Duncan McIntosh has contended that SCMA and The Dunes are trying to capitalize on the reputation and sweat equity from the boat show business he has personally built over 30 years, the company stated.
The injunction provides trademark law protection for the annual spring boat show previously held at the Dunes, but now held at Lido Marina Village, Duncan McIntosh Co. said.
The judge ruled that the SCMA and The Dunes must place disclaimers on Web sites, and in all radio, television and print advertising and marketing or promotional materials, making it clear that this year’s event at the Dunes is not in any way connected with the Duncan McIntosh Newport Boat Show, according to the company.
